SARFAESI and title scrutiny

SARFAESI is the fastest way for a bank to recover. A dirty title is the fastest way to lose that right.

SARFAESI lets a lender enforce without going to court first. But the property has to be saleable, and that depends on the title.

The right it gives

Under SARFAESI a lender can take possession and sell the secured property without a court order in most cases. That is a strong right, and it is exactly why the security has to be sound.

What can defeat it

If the title is defective, the borrower or a third party can challenge the sale. A gap in the chain, an undisclosed charge, a pending suit, or a prior interest can stall enforcement and turn a quick recovery into years of litigation.

The link to scrutiny

The scrutiny report is what tells the lender the title is clean enough to enforce. A clean title means the collateral can be sold; a defective one means the SARFAESI route may be blocked at the first objection.
