CERSAI registration, explained
Every lender thinks its own charge is safe. The ones who file late find out it is not.
CERSAI is the central registry of security interests. If a charge is not registered there in time, a lender can lose priority to one that is.
What CERSAI is
The Central Registry records mortgages and charges over property, so that anyone extending credit against a property can see what already sits on it. It is the single record that lets a lender check for prior claims before it lends.
The timing requirement
Registration has to happen within the window set by the rules after the charge is created. A lender that registers late can find itself behind an earlier interest, which is a risk in a recovery.
In the scrutiny framework
A title check reads CERSAI alongside the EC and the title. Where a security interest appears in one and not the other, that is a query. The two records have to agree before a title is treated as clear.
